DMCA / Copyright Policy

dirty. respects the intellectual property rights of others and expects users to do the same. This policy describes how copyright holders can request removal of infringing content and how affected users can respond.

1. DMCA Safe Harbor

dirty. operates in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and comparable provisions under applicable international law. As a service provider, dirty. qualifies for safe harbor protection under the DMCA by maintaining a designated copyright agent, implementing a takedown and counter-notice procedure, and terminating accounts of repeat infringers.

2. Designated Copyright Agent

dirty. has designated a copyright agent to receive notifications of claimed copyright infringement:

3. Filing a Takedown Notice

If you believe that content on dirty. infringes your copyright, you may submit a takedown notice to the designated copyright agent. Your notice must include:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material you claim is infringing, including sufficient information to locate it on the platform (e.g., URL or description).
  • Your contact information (name, address, email, phone number).
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  • Your physical or electronic signature.

Incomplete or fraudulent takedown notices will not be processed. Knowingly submitting a materially false takedown notice may result in liability for damages.

4. Takedown Procedure

Upon receipt of a valid takedown notice, dirty. will:

  • Remove or disable access to the allegedly infringing material promptly.
  • Notify the user who posted the content of the takedown.
  • Provide the user with a copy of the takedown notice and instructions for filing a counter-notice.

5. Counter-Notice Procedure

If you believe your content was removed in error or is not infringing, you may file a counter-notice. Your counter-notice must include:

  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • Your name, address, and phone number.
  • A statement that you consent to the jurisdiction of the federal court in your district (or Berlin, Germany for non-U.S. users) and that you will accept service of process from the party who submitted the takedown notice.
  • Your physical or electronic signature.

Counter-notices should be sent to legal@dirty.com with the subject line "DMCA Counter-Notice."

6. Content Restoration

Upon receipt of a valid counter-notice, dirty. will forward the counter-notice to the original complainant. If the original complainant does not file a court action within ten (10) business days, dirty. will restore the removed content within fourteen (14) business days after receiving the counter-notice.

7. Repeat Infringer Policy

dirty. maintains a policy for the termination of accounts belonging to repeat copyright infringers. Users who receive multiple valid takedown notices may have their accounts suspended or permanently terminated. The determination of repeat infringer status is made at the sole discretion of dirty.

8. Reservation of Rights

dirty. reserves the right to remove any content at any time, with or without a formal takedown notice, if it reasonably believes the content infringes copyright or violates platform policies. dirty. is under no obligation to adjudicate copyright disputes between users.
